After a month and a half Javito still without having the chance to play for Deportivo. FIFA finally took the case, but it refused to give the transfer to the winger, now Depor is taking the case to an independent tribunal trying to unblock everything.

Francisco Javier Peral ‘Periane Javito’ was dreaming of debuting at Primera División and for that reason he decided to sign for Deportivo during the past winter window, but he never imagined that he would last so much in fulfilling his dream.

Actually, one and a half month after signing for Depor he still without having the chance to play for the Galician club. The problem still related to his failed transfer. FIFA initially rejected the operation due to two reasons: the fact that the information was introduced one day after the deadline in the transfer system, and the fact that there was a contradiction in the information as his former club Aris reported that the operation was a transfer, while Depor said that it was a loan.

Then the FIFA Players' Status Committee took the case and it lasted one and a half month to analyze it, and it finally did it on the past Friday. Unfortunately for Deportivo and Javito the instance rejected the case arguing that the player was ending contract with Aris in June and for that reason it isn’t legal to accept a loan operation as Depor informed previously.

If the Committee would have accepted the operation, then Javito would have been available for the past match against RCD Espanyol. But now that the operation was rejected there’s no way to appeal the case before FIFA. Now the only way out is to take the case to an independent tribunal, which is the Court of Arbitration for Sport (TAS).

The TAS is an international arbitration body set up to settle disputes related to sport. Its headquarters are in Lausanne and its courts are located in New York, Sydney and Lausanne, Switzerland. The body was originally conceived by International Olympic Committee (IOC) President Juan Antonio Samaranch to deal with disputes arising during the Olympics, but now it also deals with cases from other sports, including football.

Now the hope of Deportivo is to solve the case of Javito with the support of the TAS as Italian club Catania did with the case of striker Gonzalo Bergessio. The Argentine player was signed from Saint-Etienne during the January transfer window, but could not play because of lengthy delays in the paperwork. The Italians took the case to the TAS after FIFA initially denied the transfer, and by mid-February they were already receiving the okay. Currently the striker is available to play at Calcio Serie A.

But there’s also a negative precedent, the one of striker William Ferreira, who was loaned from Bolivian club Bolivar to Real Valladolid during January, an operation that like the case of Javito was blocked by FIFA due to problem with the matching m or TMS. The case was appealed to the TAS, but on the past Friday the instance denied the transfer.

Anyhow, the hope of Deportivo is that the case can be studied on this Friday and that he could be even be available for the match against UD Levante. In the meantime, Javito still training at Abegondo patiently waiting to solve his case. So far, he already missed seven matches: Getafe, Villarreal, Almeria, Real Madrid, Osasuna, Real Sociedad and Espanyol, but still can play in the last ten matches in liga and in this way fulfill his dream of playing at Primera.
